CEA ACT Against Private Hospitals: Rajya Sabha MP from Delhi Swati Maliwal has raised the issue of private hospitals and health insurance companies in the Parliament regarding the loot in the name of multispecialty and superspeciality facilities. Swati, speaking on behalf of the families of patients who have been and are still falling victim to the highhandedness of private hospitals, said that when a patient goes to a private hospital in an emergency, he is treated later and first he is asked about insurance and money. In these private hospitals, rooms like deluxe, premium and suite are being charged more rent than five star hotels.

He further said that basic things like thermometer, gloves, mask, sanitizer are also added to the bill. Expensive branded medicines are prescribed in place of normal medicines and many times more tests are done than necessary.

MP Swati said that the problem is not limited to hospitals only, but insurance companies are also harassing people by increasing premiums and rejecting claims on minor conditions. The result is that every year lakhs of families fall into debt due to medical expenses. He reminded that in the year 2010, the Clinical Establishment Act was passed, under which the states were given the right to fix the maximum rates of medical services, but even today only 12 states have adopted this law, while the country’s capital Delhi has also not implemented it yet.

Maliwal demanded from the government that Clinical Establishment Act should be made mandatory in all the states and along with this, in case of emergency, first treatment, then the bill should be made a law. Apart from this, he demanded that a transparent and fair billing system should be implemented in hospitals and strict monitoring should be maintained on the increase in insurance premiums. MP Ms Swati Maliwal said that it is the responsibility of the government to treat patients in private hospitals as human beings and not as a source of revenue. This is a question of the health system of the country and the dignity of the common citizen.

Clinical Establishment Act, 2010 is a law made by the Government of India for registration and standardization for all clinical institutions (hospitals, clinics, nursing homes, diagnostic labs), both public and private. Its objective is to ensure better, safe and affordable medical care to patients, which includes all medical practices and medical systems. Under this, state governments can also decide the maximum medical rates.
