With the change of power in America, swords have been drawn between the Trump administration and the judiciary. Indian-origin federal judge Arun Subramaniam has given a decision that has not only shaken the White House but has also forced the world’s richest man Elon Musk to enter the fray. The case is related to freezing of child care and social services funds worth 10 billion dollars (about Rs 840 billion), which the judge has currently put on hold. The Trump administration had stopped this fund being given to five Democrat ruled states like New York and California saying that huge fraud was taking place in it. The administration alleges that this money is being used for illegal immigrants. But Judge Subramaniam, appointed by Biden, put an interim stay of 14 days on this order of the Trump government. He argued that stopping the funds would have a devastating impact on poor families and it was necessary to maintain the status quo for now.

Elon Musk’s sharp attack: ‘Activist disguised as a judge’
After this decision, Elon Musk opened a front on social media platform X. Describing this as a threat to democracy, Musk said, “If despite Republican control of the House, Senate and Presidency, voters are not able to influence the results, then we are not living in a democratic regime.” He termed Judge Subramaniam as an ‘activist in the guise of a judge’ and accused him of promoting fraud. Along with Musk, Fox News anchor Laura Ingraham also called the judge a part of the resistance. Republican supporters say that a single judge cannot stop the anti-corruption campaign of the entire administration. Trump administration officials argue that federal courts do not have the authority to force the executive to release funds, especially when the case involves misuse of taxpayer money.

Legal battle and reference to the poor
On the other hand, New York Attorney General Letitia James has welcomed this decision. He described the Trump government’s action as political vendetta. According to James, withholding funds would have caused significant harm to domestic violence shelters and low-income families. Department of Health and Human Services (HHS) Deputy Secretary Jim O’Neill has said that he will comply with the court order, but will definitely appeal against it. The Trump administration clearly says that they do not want to release a single dollar without thorough investigation and seeing the receipts. Now after 14 days the court will consider imposing a longer ban on it. Till then, this battle of judiciary versus executive in America is going to become even more interesting.
